hi! ich bin ein ausländer bzw kameruner wohnhaft in de BRD seit 97 mit eine aufenthaltbewilligung zum studieren.
meine aufenthahlbewilligung ist seit august 2005 net mehr gultig da ich es net verlängern konnte,hatte einige privaten probleme und muste nach frankreich reisen um die zu lösen,dadurch kam es zu stande.
nun habe ich vor, da es mir besser geht mein studium wieder aufzunehmen und es zu ende bringen.ich weis net wie zu verfahren ist.( laufe seit dem ohne gultige aufenthalterlaubnis und es mach mich zu schaffen.)
2- meiner deutsche freundin ist jetz von mir schwanger und bekommt das baby in ein paar monaten und ich würde gern bei denen bleiben, also frage:
ist es möglich das ich durch die gebuhrt meines kindes oder früher noch dies bekomme.wenn ja wie und unter welches bediengungen?
bin verzweifel und biete sie hiemit um rat.

I hope you don't mind, that my reply is in english. I just thought it might be more convienient to you. If you need a reply in german language, please don't hesitate to message me.

First of all you lost your right of abidance in germany in August 2005. This COULD, under certain circumstances have legal consequences e.g. immediate expulsion. According to §42 AuslG (Immigrationlaw would be the most fitting circumscribtion) you have to leave the country as soon as your certificate of abidance expires. Usually the person concerned receives a note for an audition. That's the point where you should start and search for an attourney at law. Your lawyer is not obliged to report your unlawful abidance in germany, so you will be save, telling him the whole Story... BUT... if I was you, I would refrain from bursting into the next immigrationsoffice trying to get a new visa. Worst case could be immediate explusion. Take a lawyer and discuss your case.
Another good chance to stay in germany would be the marriage to your girlfriend and mother of your child. This would allow you to apply for permanent residence in Germany. Another chance could be our civilcode. According to the BGB (Civilcode,le code civile) the wellbeing of a child is granted by the presence of mother AND father. Under certain circumstances the birth of your child could be the required "anchor" to stay here. Again: try and find a lawyer, consult him and make sure the next step is the right. Any mistake could lead to immediate expulsion - which is neither a solution for you nor for your child and girlfriend. I know lawyers ain't cheap... but then again you may try and trade out a deal for an initial consultation (say 50€ or so). Good luck!
